Data Protection Declaration

Personal data (hereinafter referred to simply as “data”) will be only processed by us if necessary and for the purpose of providing a functional and user-friendly website, including its contents and the services offered.

In accordance with Article 4 para. 1 of the Directive (EU) 2016/679, i.e. the General Data Protection Regulations (hereinafter referred to as “GDPR”), the term “processing” refers to any process carried out with or without the aid of automated procedures or any such series of operations in connection with personal data such as collection, capture, organisation, ordering, storage, adaptation or altering, reading out, querying, use, disclosure through transmission, dissemination or any other form of provision, reconciliation or association, restriction, erasure or destruction.

In the following data protection declaration we will provide you with information on the type, scope, purpose, duration and legal basis of processing personal data, provided we make the decision on the purpose and means of processing on our own or with others. Furthermore, in the following we will inform you about the foreign components used by us for purposes of optimisation as well as increasing the quality of use, provided that third parties are personally responsible for the processing of such data.

II. Rights of the users and persons involved

In view of the following more detailed description of data processing, the users and persons involved have the right to

  • obtain confirmation on whether their data will be processed, gather information on the processed data, obtain further information about data processing as well as the right to request copies of the data (cf. also Article 15 GDPR);
  • rectify or complete incorrect or incomplete data (cf. also Article 16 GDPR);
  • request an immediate deletion of their personal data (cf. also Article 17 GDPR), or alternatively, provided another processing is necessary in accordance with Article 17 para. 3 GDPR the restriction of processing in accordance with Article 18 GDPR;
  • obtain his/her data and the data provided by him/her and to have this data transmitted to other providers/persons responsible (cf. also Article 20 GDPR);
  • complain to a supervisory board, provided they are of the opinion that the data is being processed by the provider in violation of the data protection regulations (cf. also Article 77 GDPR).

Furthermore, the provider is obliged to inform all recipients, to whom data may have been disclosed about any corrections or deletion of the data or the limitation of processing, which takes due to Articles 16, 17 para. 1, 18 GDPR. This obligation does not apply provided this communication is impossible or is associated with excessive effort. Nevertheless, the user has to right to obtain information about this recipient.

Similarly, as per Article 21 GDPR, the users and persons concerned have the right to appeal against the future processing of their data, provided the data is processed by the provider in accordance with Article 6 para. 1, lit. f) GDPR. Lodging a complaint against data processing for the purposes of direct advertising is permissible.

III. Information about data processing

The data processed during the use of our website is deleted or blocked as soon as purpose of storage is no longer applicable, there are no legal storage obligations that stand in the way of the deletion of data and if nothing is stated to the contrary on the individual processing procedures.

Server data

For technical reasons, particularly to guarantee a safe and stable website, the data is transmitted to us or our webspace provider by your internet browser. So-called server log files gather information such as type and version of your internet browser, operating system, the website you accessed to switch to our website (referrer URL), the website(s) on our website that you accessed, date and time of the respective access and the IP address of the internet connection that made it possible for you to use our website.

The data gathered in this manner is stored temporarily but not with the rest of your data.

The data is stored on the legal basis of Article 6, para. 1, lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality and safety of our website.

The data is deleted within seven days provided further storage is not required for purposes of proof. Otherwise, the data is exempt from complete or partial deletion until the incident has been investigated.

Cookies

a) Session-Cookies

This processing makes our website more user-friendly, effective, and secure, because it allows us, for example, to display our website in different languages or offer a shopping cart function.

The legal basis for such processing is Article 6 Para. 1 lit. b) GDPR, insofar as these cookies are used to collect data to initiate or process contractual relationships.

If the processing does not serve to initiate or process a contract, our legitimate interest lies in improving the functionality of our website. The legal basis is then Article 6 Para. 1 lit. f) GDPR.

Session cookies are automatically deleted after your visit.

b) Third-party cookies

If necessary, our website may also use cookies from partner companies with whom we cooperate for the purpose of advertising, analysis, or the functionalities of our website.

c) Disabling cookies

You can prevent or restrict the installation of cookies by changing the settings on your browser. Likewise, cookies that have already been stored can also be deleted at any time. However, the steps and measures required vary, depending on the exact browser you use. Contract processing

The data transmitted by you to use our range of products or services, are processed by us for the purposes of data processing and are therefore, necessary. Conclusion of a contract and contract processing are not possible with your data.

The legal basis for this processing is Article 6 para. 1, lit b) GDPR.

We delete the data once the contract has been completely processed. However, we need to observe the mandatory storage periods defined in tax and commercial legislation.

As part of the contract processing, we provide your data to the transport company contracted for the delivery of goods, or any applicable financial services provider, insofar as this is necessary for transfer of the delivery of goods or for purposes of payment.

The legal basis for the transfer of data is Article 6 para. 1, lit b) GDPR.

Customer account / registration function

If you create a customer account with us via our website, we will use the data you entered during registration (e.g. your name, address, or email address) exclusively for pre-contractual services, for the fulfilment of a contract, or to provide customer care (e.g. to provide you with an overview of your previous orders or to be able to offer you a so-called wish list function). We also store your IP address and the date of your registration. This data will not be transferred to third parties.

Your consent will be obtained for the processing of your data as part of the registration process and reference will made to this privacy policy. The data collected by us will only be used to provide your customer account.

If you give your consent to this processing, Article 6 para. 1 lit. a) GDPR is the legal basis for this processing.

If the opening of the customer account is also intended to lead to the initiation of a contractual relationship with us or to fulfil a contract with us, the legal basis for this processing is also Article 6 para. 1 lit. b) GDPR.

You may revoke your prior consent to the processing of your data at any time under Article 7 para. 3 GDPR with future effect. All you have to do is inform us that you are revoking your consent.

The associated processed data will be deleted, once processing is not longer required. However, we must observe any retention periods required under tax and commercial law.

Credit assessment and scoring

Soweit wir Ihnen im Rahmen unseres Waren- oder Dienstleistungsangebots die grundsätzliche Möglichkeit einer Bezahlung per Rechnung eröffnen und Sie hiervon Gebrauch machen, behalten wir uns vor, bei einer Auskunftei (wie bspw. Newsletter

If you register for our free newsletter, the data requested from you for this purpose, i.e. your email address and, optionally, your name and address, will be sent to us. We also store the IP address of the computer you used to access our website and the date and time of your registration. During the registration process, we will obtain your consent to send this newsletter and the type of content it will offer, with reference made to this privacy policy. The data collected will be used exclusively to send the newsletter and will not be passed on to third parties.

The legal basis is Article 6 para. 1 lit. a) GDPR.

You may revoke your prior consent to receive this newsletter under Article 7 para. 3 GDPR at any time with future effect. All you have to do is inform us that you are revoking your consent or click on the unsubscribe link contained in each newsletter.

Contact request / Contact options

If you contact us via email or the contact form, the data you provide will be used for the purpose of processing your request. We must have this data in order to process and answer your inquiry; otherwise we will not be able to answer it in full or at all.

The legal basis for this processing is Article 6 para. 1, lit b) GDPR.

Your data will be deleted once we have fully answered your inquiry and there is no further legal obligation to store your data, such as for subsequent contract processing.

User contributions, comments and reviews

We give you the opportunity to publish questions, answers, opinions or evaluations, hereinafter only referred to as “Contributions” on our websites. If you make use of this offer, we will process and publish your contribution, date and time of submission as well as the pseudonym you may have used.

The legal basis is Article 6 para. 1 lit. a) GDPR. You may revoke your prior consent under Article 7 para. 3 GDPR at any time with future effect. All you have to do is inform us that you are revoking your consent.

Furthermore, we also process your IP and email address. The IP address is processed because we have a legitimate interest in introducing or supporting further steps, provided your contribution infringes on the rights of third parties and/or it was carried out illegally.

The legal basis in this case is Article 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the necessary legal defence.
